ADVERTISEMENT FOR BIDS Notice is hereby given that sealed bids will be received for the "2023 Water Main Improvements - Rebid" IE project # EC22-00-116, DWSRF NO. 4700498-14, in Jamestown, North Dakota. Bids will be received by the City Administrator, at the office of the Administrator until 1:30P.M. local time on Thursday, June 29, 2023, and then at said office all bids properly submitted will be publicly opened and read aloud. Digital copies of the Bidding Documents are available at www.interstateeng.com or www.questcdn.com for a fee of $37.00. These documents may be downloaded by selecting this project from the "Bid Documents" tab and by entering Quest Project Number 8545796 on the "Search Projects" page. Paper copies of the Bidding Documents may be obtained from Interstate Engineering, located at 1903 12th Ave SW, Jamestown, ND 58401 for a fee of $100.00 per set. The project will consist of the following approximate quantities: 5700 LF Water Main installation, Asphalt and Concrete Pavement Removal & Replacement, Horizontal Drilling, gate valves, fire hydrants, and all miscellaneous work necessary therefore and incidental thereto. Bidders on this work will be required to comply with American Iron and Steel requirements of the Consolidated Appropriations Act, 2014. The requirements for bidders and contractors under this regulation are explained in the specifications. Bidders are required to comply with Davis-Bacon prevailing wage requirements. Any lead service line replacements conducted under this project must replace the entire lead service line, not just a portion, unless a portion has already been replaced or is concurrently being replaced with another funding source. Bidders on this work will be required to comply with Title 40 CFR Part 33– Participation by Disadvantaged Business Enterprises in the United States Environmental Protection Agency Programs. The requirements for bidders and contractors under this regulation concern utilization of Minority Business Enterprises (MBE), Women's Business Enterprises (WBE), and Small Business Enterprises (SBE) and are explained in the specifications. The goal for MBE is 2% of the total dollar value of the project. The goal for WBE is 3% of the total dollar value of the project. To demonstrate a good faith effort to comply, bidders must include the MBE/WBE subcontractor solicitation form in the bid package. Bidders on this work will be required to comply with the President's Executive Order No. 11246, as amended. The requirements for bidders and contractors under this order are explained in the specifications. Bidders are required to comply with Build America, Buy America Act requirements. Each bid will be submitted on the basis of a cash payment for work. It will be enclosed in a sealed envelope addressed to the above mentioned City Administrator, 102 Third Avenue Southeast, Jamestown, North Dakota 58401, and shall be designated that the bid is for "2023 Water Main Improvements - Rebid." The bid shall be accompanied by a Bidder's Bond in a separate envelope in the amount of five percent (5%) of the full amount of the bid, executed by the Bidder as Principal and by a Surety Company authorized to do business in North Dakota. If the Principal's bid is accepted by the OWNER and the contract awarded, the principal, within ten (10) days after the Notice of Award, will be required to execute and effect a contract in accordance with the terms of the principal's bid and any requirements and conditions of the OWNER. Bid and Bid Bond must be executed by a principal. Signatures by other than a president, vice president, or CEO, must be accompanied by sufficient evidence (duly executed meeting minutes, resolution, power of attorney, etc.) to indicate that the signatory has the authority to bind the company or organization. A Contractor's Bond, as required by Section 48 01.2-10 of the North Dakota Century Code, shall be included with the executed Contract Documents. The Bid Security shall be as required in Section 48 01.2-05 of the North Dakota Century Code. All bidders must be licensed for the highest amount of their bids, as required by Section 43 07 07 of the North Dakota Century Code and a copy of the license or certificate of renewal thereof issued shall be enclosed in the required bid bond envelope. Bidders are notified that all applicable provisions of the Copeland Act (29CFR Part 3) and the Davis Bacon Act (29 CFR Parts 1, 3 and 5) are in force on this project. All bids shall be contained in a sealed envelope plainly marked for "2023 Water Main Improvements - Rebid". In addition, the Bidder shall place upon the exterior of said envelope the following information: a) The work covered by the bid. b) The name of the person, firm or corporation submitting the bid. c) The license number and class of license of the bidder. d) A copy of the license or certificate of renewal thereof issued shall be enclosed in the required bid bond envelope. e) Acknowledgement of each Addendum. f) Bid Bond in outside envelope. (Signed by Principle or authorized person with copy of authorization.) g) MBE/WBE solicitation form in the outside envelope. No bid will be read or considered which does not fully comply with the above provisions as to Bond and Licenses, and any deficient bid submitted will be resealed and returned to the Bidder immediately. The OWNER retains the right to reject any or all of the bids submit¬ted and to waive any informality in any bid and to hold all bids for a period not to exceed thirty (30) days from said date of opening and to hold the three low bids and bid securities for a period not to exceed sixty (60) days from said date of bid opening. The work on the improvements is to commence upon a date to be specified by the OWNER, notice of which will be given to the suc¬cessful bidder ten (10) days in advance of the start of construction. The Contractor will be required to commence construction, and in an approved sequence, complete the project by October 19, 2024.
